Impossible - A FBI Criminal Record Check!
A company I want to work for is conducting a background check. Can they do an FBI criminal record check? The answer to that question is no. I'm sure that they wished that they could, it would make things much simpler for them.
It is illegal for the public to have access to the FBI criminal record check database; Although information from this database is sought by many and is even sold on the black market. It is totally illegal for a company to solicit or to pay for information that comes from this database.
The only people that have access to FBI criminal record check is you and people within the department.
An FBI criminal record check is referring to the criminal history and information that the FBI might have, information such as your fingerprints and arrests. Some foreign countries require that you have it to live and work in that particular country. Requesting an FBI criminal record check cannot be done, not even by you though. When you need an criminal record check for employment then the FBI will send you to your state and request that you get your background check through a state identification bureau. If another state or federal agency is requesting the FBI criminal record check, they will know what to do and where to go. As mentioned before, an employer cannot go directly to the FBI, but they can get your federal criminal record through the state court system. It will be listed there. They will also go to the county and district courts from the places you have lived in the last 10 years to find out if you have a criminal history. When an employer does a background check, they usually do a thorough check. They will conduct a SSN verification to make sure that your addresses are what you say they are, that you are the person you say you are. Then they will go to the district, county, and federal offices to get a copy of your criminal history. This is where your federal criminal history will show up if you have any federal convictions. In conclusion, although only you can request your FBI criminal record check, an employer can and will find out if you have any federal criminal history, arrests or convictions. An employer does a thorough check to make sure that he is hiring the right person and that he can never be sued for negligent hiring practices. So if you believe that just because an employer cannot conduct a criminal record check, he will not be able to see that you have a federal criminal history and background. Think again, because the employer will come up with the information in a round about manner.
