Can an Employer or an Individual Request Their Federal Criminal Record?

The federal criminal record can be acquired through your states justice department system. It cannot be acquired directly through the FBI, unless it is directly requested by the person themselves.

In fact, it is illegal to acquire information directly from the FBI data base, although the information located on this database is highly sought after. The FBI sends pertinent information to the justice department, which can then be accessed by employers and other people. The federal criminal record database from the FBI is not open to the public. Although the individual themselves can request a copy of their record from the FBI for the purpose of working overseas, or because they need it in order to adopt a foreign child.

The records obtained directly from the FBI cannot be used either by the individual or the employer for employment reasons. That federal criminal record needs to be located at your local justice offices.

There are certain industries where federal background checks are essential, and the information is pulled from the justice system. These fields include education, child care, elderly care, and adult care fields. The federal background checks are required by the government to make sure that companies keep these people that are reliant on their providers safe from criminal offenses.

This type of background check may not be the correct answer to our problems, especially because it leaves out a whole lot of people that only want another opportunity to work within their communities. But up until now it is the safest system we as a society have to make sure that the people that work with us are not criminals and are not going to kill us in our sleep.
